July 29, 2016 – Motions for judgment as a matter of law filed by Plaintiff CardiAQ Valve Technologies, Inc. (“CardiAQ”) and by Defendants Neovasc Inc. and Neovasc Tiara Inc. (“Neovasc”) were denied. In CardiAQ’s motion, it moved to overturn a jury finding that Neovasc did not breach its duty of honest performance in the Purchase Orders between the two companies, and Neovasc contended that no reasonable jury could find that it breached the duty of honest performance in the non-disclosure agreement between the parties. Neovasc owns U.S. Patent No. 8,579,964, titled “Transcatheter Mitral Valve Prosthesis.” The case is Civil Action No. 14-cv-12405 before the United States District Court for the District of Massachusetts.
