November 4, 2016 – The court granted a motion to dismiss a complaint filed by Plaintiff Disc Disease Solutions, finding that Disc Disease had failed to explain how Defendants VGH Solutions, Inc., Dr-Ho’s, Inc., and Hoi Ming Michael Ho (collectively, “Defendants”) infringed on any of the patent claims. The patents-at-issue in the case are U.S. Patent No. 7,618,509, titled “Wrinkled band without air expansion tube and its manufacturing method,” which relates to a belt-type band used for healing or preventing a hernia of intervertebral disk; and U.S. Patent No. 8,012,113, titled “Spinal brace,” which relates to a flexible air injectable band which provides support by compression to the spinal cord. The complaint was filed in the United States District Court for the Middle District of Georgia, and is number 1:15-cv-188.
