District Judge Denies Motion for Attorney Fees and Motion for Sanctions in Surgical Device Lawsuit

On June 22, 2017, Stone Basket Innovations LLC previously instigated a lawsuit against Cook Medical LLC in the United States District Court for the Southern District of Indiana; the lawsuit involved an endoscopic surgical device. After the asserted claims of plaintiff’s patent were cancelled during inter partes review, District Judge Larry J. McKinney denied defendant’s motions for attorney fees and sanctions on June 20. The patent at issue is U.S. Patent No. 6,551,327, entitled “Endoscopic Stone Extraction Device with Improved Basket.” This case has been given Civil Action No. 1-16-cv-00858.
