Baxter Files Patent Infringement Complaint Against Becton Dickinson Over Drug Transfer Device Technology

October 20, 2017 – Baxter International, Inc. filed a complaint for patent infringement against Becton, Dickinson and Company on October 19, 2017 in the United States District Court for the Northern District of Illinois (Eastern Division).  The lawsuit relates to Becton Dickinson’s allegedly infringing PhaSeal System, a closed system drug transfer device that prevents exposure to hazardous drugs, from drug preparation to IV administration.  The patents at issue are U.S. Patent Nos. 5,989,237 and 6,159,192, both entitled: “Sliding Reconstitution Device With Seal.”  The complaint has been given Civil Action No. 1:17-cv-07576 (N.D. Ill.).
